Wisconsin is a mandatory P.L. 280 state except the Menominee Reservation (retroceded). The Red Cliff Band, Forest County Potawatomi, and Lac Courte Oreilles Tribe reassumed exclusive jurisdiction over ICWA child welfare matters, which may apply. The state's purpose clause of juvenile court is one of 3 states that specifies considerations for AI/AN youth.  See Tribes of Wisconsin and WI Tribal Relations Initiative.

The Wisconsin Department of Justice completed an assessment in 2014 for the whole state. Data was assessed from 2006 to 2012 for African American, Asian, and American Indian youth. Decision points assessed included arrest and detention. Research methods included multivariate analysis.
