North Dakota is not a P.L. 280 state, but the state has criminal jurisdiction over Spirit Lake (was Devil’s Lake) by an earlier federal law (60 Stat. 229, 1946, access here). ND was considered an optional P.L. 280 state for civil jurisdiction, subject to tribal and individual acceptance, but the process was deemed invalid under case law and not reinstated. See NDCC 27-19-02 and ND Indian Affairs Commission.
