Nebraska is a mandatory P.L. 280 state with exceptions: Winnebago (initially excluded, then retroceded criminal jurisdiction, and then reassumed exclusive tribal jurisdiction over child welfare matters which could apply), Omaha (initially excluded, then retroceded, except traffic), and Santee Sioux (retroceded). NE is one of only 3 states that specifies considerations for AI/AN youth in its purpose clause of juvenile court. See Nebraska Commission on Indian Affairs.

The Nebraska Crime Commission completed an assessment in 2012 for several local jurisdictions. Data was assessed for 2011 for African American, Hispanic, Asian, and American Indian youth. Decision points assessed included arrest, diversion, detention, petition, probation, confinement, transfer to adult court, and placement. Research methods included interviews, surveys, focus groups, multivariate analysis, and descriptive statistics.
